According to the Ministry of Inclusion, the new Immigration Regulations are scheduled for approval on November 19th. This new set of regulations will bring significant changes and open up new opportunities for the regularization of foreign nationals in Spain. Originally, the estimated date for approval was November 12th, but due to adjustments in the Council of Ministers' schedule, it has been moved to November 19th. This is a critical date, as once approved, the new regulations will introduce additional pathways to regularization and adjust existing procedures such as arraigo (rooting processes) and asylum applications.

Key Expected Changes:

• Modifications to the Arraigo Process: The various types of arraigo—social, employment-based, and family-based—will now be standardized to a two-year duration, simplifying access to regularization. The reform will also introduce new employment options under the “arraigo formativo” and “arraigo socio-laboral” processes.

• New Provisions for Asylum Applicants: A specific transitional process is anticipated for asylum seekers, providing an alternative to the current “second chance arraigo” with clearer criteria for each case.

• Adjustment of Second Chance Arraigo: This type of arraigo will become a less common procedure but will remain available for cases that do not meet other requirements.

Additionally, it is important to note that the government has expressed its intent for this new regulation to offer sufficient pathways for regularization, which could lower the likelihood of an additional extraordinary regularization process, as had been proposed in parliament.
