Final Days to Apply for Spanish Citizenship under the Democratic Memory Law (LMD): What If You Didn’t Apply in Time?
The deadline to apply for Spanish citizenship through the Democratic Memory Law ends on October 23, 2025. What if you couldn’t apply? What if you applied and still have no response? Here’s what you need to know.
For the past three years, thousands of descendants of Spaniards have applied for Spanish citizenship under the Democratic Memory Law (LMD). This law allowed children and grandchildren of Spaniards—especially those exiled or who lost nationality for political or historical reasons—to recover their Spanish citizenship.
But now we are at the end. On October 23, 2025, the deadline to submit new applications officially ends. After this date, the law expires.
If you still haven’t submitted your application or if you did and haven’t heard back yet, don’t worry—here’s a clear explanation of your options.
If you need legal help urgently before the deadline or want a lawyer to check your situation, you can book a consultation with an expert lawyer here:

1. What exactly ends on October 23, 2025?
This date marks the end of the legal period for submitting new applications for Spanish citizenship under the Democratic Memory Law. From October 24 onwards:
-
No new LMD citizenship applications will be accepted.
-
Consulates and Civil Registries will not register new files.
-
Only applications submitted before the deadline will remain valid.
2. What if I couldn’t get an appointment at the consulate?
This is the most common problem. Many consulates did not offer enough appointments, and thousands of people were left without a chance to apply.
If you still want to try before October 23, you can:
-
Send your application by postal mail to the Civil Registry or consulate (with tracking or proof of delivery).
-
Submit your documents to the Dean of the Civil Registry in Spain, if you’re legally in the country.
-
Have a lawyer submit your documentation, leaving legal proof that you attempted to apply within the deadline.

3. I already applied but I haven't received any answer. Will I lose my rights?
No. If you submitted your application before the deadline—even if you don’t have an answer yet—your file is valid and will continue being processed.
Make sure you keep:
-
A receipt or stamped copy of your application,
-
A submission email or file number,
-
Proof of postal delivery or registry entry.
If you don’t have any proof, it’s essential to request it or ask the consulate to certify your submission.
4. Will there be an extension or a new law?
As of now, there is no official announcement of an extension. The deadline remains October 23, 2025.
However, there are discussions about modifying the Spanish Civil Code in the future to allow descendants of Spaniards to apply for citizenship permanently, without temporary laws like the Historical Memory Law (2007) or the Democratic Memory Law.
5. What if the deadline passes and I didn’t apply?
All is not lost. You still have alternative legal options:
-
Spanish citizenship by residency (after 2 years for Latin Americans, Portuguese, Filipinos, Equatorial Guineans, Andorrans or people of Sephardic origin; 10 years for others).
-
Arraigo Familiar (Family roots) if you are a child or grandchild of a Spanish national.
-
Contesting the denial of an appointment, if you were prevented from applying.
-
Waiting for future reforms for descendants (currently under discussion).

Frequently Asked Questions (FAQ)
1. Can I send my application by postal mail if I couldn’t get an appointment?
Yes. Postal submission to the consulate or Civil Registry with proof of delivery is a legally valid method to show you applied within the deadline.
2. What if the consulate never gave me an appointment?
You can still send your documentation by certified mail or through a lawyer who registers it officially before the deadline. It creates legal proof that you attempted to apply.
3. How long do LMD citizenship applications take to be processed?
It varies widely. Some consulates take 6 to 18 months. The important thing is to apply before the deadline. Resolutions can come even after the law expires.
4. Can I travel to Spain and submit the application here?
Yes, but only if you are legally in Spain before the deadline. Some Civil Registries may not accept new requests because of lack of time.
Conclusion
The Democratic Memory Law has helped thousands of families reconnect with their Spanish roots. But its time is ending. If you can still act before the deadline—do it. If not, don’t worry. There are still legal alternatives.
