Official guidelines have been published on April 18, 2023, on how to legally apply for this type of permit, and here we explain it to you.

The new Law 28/2022, better known as Startups Law has brought us a new visa and authorization for those foreigners who want to live work from for companies located outside of the country as digital nomads.

Recently during the current month of April 2023, an Instruction from the Government regarding the application of this kind of permits and visas has been published.

In this article we are going to see the most important points of such Instruction:

 1- Proof of sufficient economic resources.

Applicants must prove that they have financial resources for themselves and their family members in accordance with the following amounts:

a) Holders of residence authorizations: amount representing monthly 200% of the minimum interprofessional wage (SMI).

b) Family units that include two persons: at least 75% of the SMI. A 25% of the SMI will be required for each additional member to the two mentioned persons.

Any means of proof can be used to accredit this point.

2- Certificates of criminal record

a) Applications for visas and residence authorizations must be accompanied by a criminal record certificate from the country or countries where the applicant has resided during the last two years.

b) The above will not be applicable in the case that the applicant owns a residence permit for Spain for more than 6 months.

3- Public or private health insurance

The applicant of this kind of authorizations of residence will need to prove a public or private insurance of disease arranged with an insurance company authorized to operate in Spain. Travel insurances are not accepted.

If the applicant is a citizen from a country that have a social security agreement with Spain, a certificate issued by the competent institution of the State in whose social security system the applicant is insured must be provided.

If the applicant is covered by an international standard of coordination of social security systems but the same does not provide for such coverage, the applicant must prove that he/she has public or private health insurance that provides coverage comparable to that provided by the National Health System.
