Work Permit in Spain for 2023
5 option to get a work permit in Spain this year.
Spain is one of the countries with a higher number of residence applications in the European Union.
Our country has become the perfect destination for many people who choose it to study, work or invest in Real Estate. .
At Visal Immigration we help you managing all the process and advising all those people who wish to reside, work and invest in Spain.
This time, we have prepared a list of the 5 main permits that would allow you to work in Spain, since not all the residence permits include a work permit.
1- RESIDENCIA POR CUENTA AJENA
This is the most demanded authorization to be able to work in Spain.
To be eligible for this permit, you must have a full time job offer of at least one year with a spanish company.
The main disadvantage is that you need to overcome the National Employment Situation ( which is very difficult given the high demand situation in the Spanish labor market).
This means that the employer, before requesting the permit for the foreigner who is outside Spain, must publish such offer in the Public Employment Service, in order to verify if there is any legal resident or Spaniard who can fill that job position.
The main requirementst are:
- Not having criminal backgrounds in Spain and in their previous countries of residence, during the last five years.
- Not to suffer any of the diseases susceptible of quarantine foreseen in the International Sanitary Regulations.
- To possess the required training for the exercise of the profession.
- That the national employment situation allows the hiring. It allows it if:
- Present an employment contract signed by the employer and the worker that guarantees the worker a continuous activity during the period of validity of the work authorization. The starting date of the contract must be conditioned to the moment of effectiveness of the work authorization.
- The conditions set out in the employment contract must comply with those established by the regulations in force.
- The applicant employer must be registered in the Social Security system and be up to date with its tax and Social Security obligations.
- The employer must have sufficient economic, material or personal means for its business project and to meet the obligations assumed in the contract with the worker.
2- RESIDENCIA PARA PRÁCTICAS PROFESIONALES
The second option we can apply for in order to obtain a permit to work in Spain is the Residence Authorization to do an Internship.
This is an authorization that entitles to reside in Spain and to participate in an internship program by signing an internship agreement or internship work contract in order to improve knowledge, practice and experience in a professional environment.
According to that, foreign students who have obtained a higher education degree in the two years prior to the date of application or who are pursuing studies leading to a higher education degree may apply.
The internships to be carried out may be non-working (through an internship agreement) or working (through an internship employment contract).
It can be processed quickly and easily at the Immigration Office. In addition, it allows the worker to be hired whether he/she is in his/her country of origin or in Spain legally. This type of permit has a maximum duration of two years.
3- RESIDENCIA COMO PROFESIONAL ALTAMENTE CUALIFICADO
If you are a highly qualified professional or manager or a graduate or postgraduate of prestigious universities and business schools and you have a job offer in Spain, you can benefit from the PAC residence regime.
This type of permit is intended for workers who are either highly qualified and trained or have extensive experience. The characteristic of these permits is that the job offer must state a salary of around 40,000 euros per year.
For this reason, it is called Highly Qualified Professional, since it is intended for people with high qualifications.
The Residence Permit is requested through the Large Companies Unit. Once this permit has been granted, the worker must obtain the corresponding visa if he/she is in the country of origin. If, on the other hand, he/she is in Spain, he/she may go directly to apply for his/her physical card.
In this type of permit and residence for highly qualified workers, it is not mandatory to have passed the National Employment Situation.
4- TARJETA COMUNITARIA
Family members of a Spanish citizen or of another European Union Member State, or of another State party to the Agreement on the European Economic Area or Switzerland, who do not hold the nationality of one of said States, when they join or accompany him/her, and are going to reside in Spain for a period of more than three months, must apply for and obtain a Union citizen's family member card.
This residence permit for family members of European and Spanish citizens incorporates a work permit that allows them to work both for themselves and for others.
The only limitation that we can find is that of those relatives who must have accredited to be in charge of the Spanish or Community citizen, as in the case of the ascendants or the children older than 21 years. These relatives could work but in a limited way and without that work supposes a source of regular and stable income.
If such work becomes their own source of income, they will have to apply for a modification of the community card to the authorization of residence and work that corresponds in general regime.
5- PERMISO DE ESTANCIA PARA ESTUDIANTES
The authorization of stay shall authorize self-employment and employment, provided that this work activity is compatible with the completion of these studies, and it is a higher education, a regulated training for employment or aimed at obtaining a certificate of professionalism, or training leading to obtaining the certification of technical aptitude or professional qualification necessary for the exercise of a specific occupation.
