How to get the permit
If you are going to work in Spain in a top management or highly qualified position for a prominent company, you can benefit from the advantages of the residence permit for highly qualified workers.
You can also benefit from this permit if you are a graduate or postgraduate student from a prestigious university or business school and have a job offer in Spain from any company in the country.
You can request a residence permit for up to 3 years, which can be renewed every 2 years at the end of its validity.
It will allow you to travel unlimitedly to all countries within the Schengen Area, without the need to process a different visa for each one of them.
Bring your family members along.
You will not be required to overcome what it is known as the National Employment Situation.
You will be allowed to apply for this residence permit even from outside of Spain. In this case, it will be necessary to apply for the visa at the Spanish embassy of the applicant's country of residence or nationality, once you have the residence permit approved.
You have several options.
Initial Residence Permit as a Highly Qualified Professional
Currently, under the new text of the Entrepreneurship Law, any company (regardless of its size) that needs to bring in a highly skilled foreign professional to perform tasks related to their academic background can apply for this permit in Spanish territory.
You can apply for this permit for yourself and your family members if you meet one of the following conditions:
-
You have a job offer in Spain to work for a company, and you hold a higher vocational training or specialist degree with professional experience at a comparable level of at least 3 years.
-
You are a graduate or postgraduate from a prestigious university or business school and have a job offer in Spain.
The initial residence authorization in Spain for highly skilled workers will be granted for a maximum of 3 years or for the duration of the employment contract if it is less than 3 years. Subsequently, you can apply for its renewal.
Considering the occupations reflected in the National Classification of Occupations (CNO-11), it will be assessed that the salary specified in the employment contract or the firm job offer is at least the annual average salary per occupational group, based on data from the National Institute of Statistics:
-
For Directors and Managers, an annual average salary of at least 54,142 euros will be required.
-
For other technical, scientific, and intellectual professionals, an annual average salary of at least 40,077 euros will be required.
The amounts indicated in the previous sub-criterion will be subject to a reduction coefficient of 0.75 in cases where the applicant is under 30 years old.
When calculating the indicated amounts, the variable part of the remuneration will not be taken into account.
In accordance with Article 26 of the Consolidated Text of the Workers' Statute Law, approved by Royal Legislative Decree 2/2015, of October 23, the in-kind salary may not represent more than 30% of the worker's total salary.
