How to get the permit

If you have been in Spain for more than 90 days already, and you have no valid residence permit right now, but you can prove that you have been staying in the country for several years, or that you have family ties in our country, you could benefit from the advantages of this kind of residence permits.

“Arraigo Laboral” could only be applied for those who are in Spain under an irregular situation at the time of applying for the permit (without a valid residence permit and no right to stay in the country). The rest of the permits inside this section could be requested either if you are on an irregular situation or not.

You have several options. 

Arraigo Social Residence Permit

With this kind of Arraigo, those applicants who can prove that they have been in Spain continuously for, at least, 3 years could get a residence permit to stay and work in Spain.

By “continuously” the Spanish law means that your absences in Spain have not exceeded of 120 days during the last 3 years.

In addition, you must meet the following requirements:

  1. Not having criminal records in Spain and in the country of your citizenship or in all the countries where you have been a resident during the last five years.
  2. Having a job contract signed by the employee and the employer that guarantees at least the “SMI” for Spain.
  3. You could get this permit without a job contract if you prove having economic funds enough to maintain yourself. However, in this case the permit won´t include an authorization to work.

 

Having family ties with other legal residents in Spain (spouses or registered domestic partners, or direct ascendants and descendants) or having a report from a local institution proving your social integration (in case you don´t have family ties in Spain).

This permit will be valid for one year. When your permit has expired you could request to change it to working permit.

Documentation

 All pages of any applicant’s passport.

 Certificate/Report that proves your social integration issued by Local Authorities of your place of residence.

 Census certificate for the last 3 years.

 Criminal record from all countries in which you have lived during the last 5 years, duly updated and legalized.

 A work contract that proves a permanent working relationship for the period of validity of the work authorization that is being requested. The duration of the contract must be at least one year and must provide income above the Spanish full-time minimum wage.

 Life report of hiring company.

 Permanent tax certificate of hiring company.

 Hiring company official set-up documents, where the name of current administrator is shown.

Please note that this fee exclusively corresponds to the issuance of the physical card (TIE), and therefore IS not included in our fees to process the residence permit.

Arraigo Laboral Residence Permit

This is a temporary residence permit that could be granted to foreign citizens who are illegally in Spain (without a valid residence permit or right to stay in the country) and have been working during at least 6 months within the last 2 years in Spain.

With this kind of Arraigo, those applicants who can prove that they have been in Spain continuously for, at least, 2 years could get a residence permit to stay and work in Spain.

In addition, you must meet the following requirements:

Arraigo Familiar Residence Permit

This is a temporary residence permit that could be granted to foreign citizens who meet any of the following requirements:

  1. Being the father or mother of a minor of Spanish nationality, or in the case you are a person who provides support to a Spanish person with disabilities. In this case, you would be granted with a 5 years residence permit, which entitles to work as an employee or self-employed person.
  2. Being married (or legal partnership) to a Spanish citizen, or being an ascendant over 65 years old or under 65 years old if you prove you are in charge, or a descendant under 21 years old or over 21 years old in charge, of a Spanish citizen. In this case, you would be granted with a 5 years residence permit, which entitles to work as an employee or self-employed person.
  3. In the case of children of a father or mother who were originally Spanish. In this case, you would be granted with a single year residence permit, which entitles to work as an employee or self-employed person.

Documentation

 Birth certificate in case of being the father or mother of a minor of Spanish citizenship

 Proof of providing support to a Spanish citizen with disabilities.

 Spanish ID card for the Spanish citizenship (DNI).

 Proof of the family link (marriage certificate, legal partnership, birth certificate…)

Arraigo para la formación Residence Permit

This is a temporary residence permit that could be granted to foreign citizens who have been in Spain continuously, at least, for two years.

By “continuously” the Spanish law means that your absences in Spain have not exceeded of 90 days during the last 3 years. 

This is a one single year residence permit only to study a professional training course. Once you have received the approval you have 90 days to submit the proof that you have been admitted at the school center for this purpose.

In order to be able to apply for this permit you should proof:

-       Not having criminal records in Spain and in the country of your citizenship or in all the countries where you have been a resident during the last five years.

-       That you have been living in Spain during the last 2 years

-       That are registered with a school for a professional training course.

 

This permit doesn´t allows you to work in Spain during this year. When your permit has expired you could try to get a working permit if needed.

 Proof that you are registered with a school to study a professional training course.
